The Website is a platform that facilitates the online purchase of handicraft items at a discounted price through various methods of payments offered including, issue of coupons and vouchers that can be redeemed.

User Conduct and Rules:

Exactness Not Guaranteed:

eShilp.com hereby disclaims any guarantees of exactness as to the finish and appearance of the final Product as ordered by the user. The quality of any products, Services, information, or other material purchased or obtained by you through the Website may not meet your expectations. Since the products are handcrafted items, guarantee of exactness can't be assured and there may be slight variations as to certain aspects of your order such as the design accuracy and intricacy, color, size, etc.

We as a merchant shall be under no liability whatsoever in respect of any loss or damage arising directly or indirectly out of the decline of authorization for any Transaction, on Account of the Cardholder having exceeded the preset limit mutually agreed by us with our acquiring bank from time to time.

Pricing:

Prices for products are described on our Website and are incorporated into these Terms by reference. All prices are in Indian rupees. Prices, products and Services may change at eShilp.com's discretion.

Shipping:

Title and risk of loss for all products ordered by you shall pass on to you upon eShilp.com's shipment to the shipping carrier.

Delivery:

eShilp.com will make a maximum of three attempts to deliver your order. In case the customer is not reachable or does not accept delivery of products in these attempts,eShilp.com reserves the right to cancel the order(s) at its discretion.

On placing your order, you will receive an email containing a summary of the order and also the estimated delivery time to your location.

Sometimes, delivery may take longer due to

1. bad weather

2. flight delays

3. political disruptions

4. other unforeseen circumstances

In such cases, we will proactively reach out to you. Please check your emails and SMS regularly for such updates

Also, we will not be able to compensate for any mental agony caused due to delay in delivery.

"The Buyer agrees that the title to the goods is transferred to the buyer at the time of placing the Order and dispatch confirmation thereof irrespective of Shipping of Goods which is to be done in due course being a separate chargeable facility"

Post Delivery:

Returns/Exchange and Refunds:

eShilp.com is committed to deliver the products ordered by you in a perfect and undamaged condition. Therefore, each product is checked properly in regards to its quality, accuracy and details as displayed on the website before dispatching the same.

eShilp.com will accept Return or Exchange only if the following conditions are met:

1. (i)  Return or Exchange request should be made within 15 days from the date of delivery of product.

2. (ii)  The tags on the product should be intact.

3. (iii)  The product should be unused and in an undamaged condition.

4. (iv)  The item needs to be returned along with the original packaging.

5. (v)  eShilp.com does not offer reverse pickup of the items, therefore, the customer will need to send us the
          shipment himself/herself whereby the shipment fee will also be borne by him/her.

6. (vi) Please note that the shipping charge would not be included in the refund value of your order as this is a non-refundable charge.

Cancellation policy:

•  If you wish to cancel your order, please contact eShilpcustomersupport as soon as possible with your order number. As long as your order has not been dispatched we can cancel it and refund your amount.
• If your order has been dispatched but yet to be delivered and you wish to cancel the order, please contact eShilpcustomersupport with your order number. We can cancel it and refund your amount but please note that the shipping charge would not be included in the refund value of your order as this is a non-refundable charge.

Termination:

1. eShilp.com may suspend or terminate your use of the Website or any Service if it believes, in its sole and absolute discretion that you have breached any of the Terms.

2. If you or eShilp.com terminates your use of the Website or any Service, eShilp.com may delete any content or other materials relating to your use of the Service and eShilp.com will have no liability to you or any third party for doing so.

3. You shall be liable to pay for any Service or product that you have already ordered till the time of Termination by either party whatsoever. Further, you shall be entitled to your royalty payments as per the User License Agreement that has or is legally deemed accrued to you.

Governing Law:

1. These Terms of Use and all transactions entered into on or through the Website and the relationship between you and eShilp shall be governed in accordance with the laws of India without reference to conflict of laws principles.

2. You agree that all claims, differences and disputes arising under or in connection with or in relation hereto the Website, the Terms of Use or any transactions entered into on or through the Website or the relationship between you and eShilp shall be subject to the exclusive jurisdiction of the courts at Udaipur, Rajasthan, India and you hereby accede to and accept the jurisdiction of such courts.

Headings:

The headings and subheadings herein are included for convenience and identification only and are not intended to describe, interpret, define or limit the scope, extent or intent of the Terms or the right to use the Website by you contained herein or any other section or pages of the Website or any Linked Sites in any manner whatsoever.

Severability:

If any provision of the Terms is determined to be invalid or unenforceable in whole or in part, such invalidity or unenforceability shall attach only to such provision or part of such provision and the remaining part of such provision and all other provisions of these Terms shall continue to be in full force and effect.

Report Abuse:

In the event you come across any abuse or if you become aware of any objectionable content or images on the Website, please report to eShilpcustomersupport.

Cancellation of Fraudulent Orders

To provide a safe and secure shopping experience, we regularly monitor transactions for fraudulent activity. In case any suspicious activity is detected, eShilp.com reserves the right to cancel all past, pending and future orders without any liability. eShilp.com also reserves the right to refuse or cancel orders in scenarios like inaccuracies in pricing of product on website and stock unavailability. We may also require additional verifications or information before accepting any order. We will contact you if all or any portion of your order is cancelled or if additional information is required to accept your order. If your order is cancelled after your card has been charged, the said amount will be reversed to your Card Account. Any promotional voucher used for the cancelled orders may not be refunded.

The customer may be considered fraudulent if any of the following conditions are met:

1. (i)  Customer doesn't reply to the payment verification email sent by eShilp.

2. (ii)  Misuse of another customer's phone/email

3. (iii)  Customer fails to produce adequate documents during the payment details verification

4. (iv)  Overuse of a voucher code

5. (v)  Customer uses invalid email and phone no.

6. (vi)  Use of a special voucher not tagged to the email ID used.

7. (vii)  Customer returns the wrong product

8. (viii)  Invalid/Incomplete address cases

9. (ix)  Customer has a very high return rate.

10. (x)  Repeated request for monetary compensation for petty issues.

(xi) Account for the customers falling in fraudulent category may be blocked.

Mis-pricing Cases

Despite our best efforts, a small number of the many items in our catalogue may get mispriced. However, we verify prices as part of our dispatch procedures.

• - If an item's correct price is lower than our stated price, we charge the lower amount and send you the item.

• - If a product's correct price is higher than our stated price, we will cancel your order and notify you of that cancellation.

Communications:

You hereby expressly agree to receive communications by way of SMS, e-mails from eShilp relating to any products or services provided through the website and offers or promotions on the website. A User can unsubscribe/ opt-out from receiving communications from eShilp through SMS and e-mail anytime by clicking on the unsubscribe option attached at the bottom of newsletter received through e-mail (registered email address).

Feedback and Information:

Any feedback you provide to this website shall be deemed to be non-confidential. eShilp shall be free to use such information on an unrestricted basis. Further, by submitting the feedback, you represent and warrant that

1. Your feedback does not contain confidential or proprietary information of you or of third parties;

2. eShilp is not under any obligation of confidentiality, express or implied, with respect to the feedback;

3. eShilp may have something similar to the feedback already under consideration or in development; and

4. You are not entitled to any compensation or reimbursement of any kind from eShilp for the feedback under any circumstances.

General Terms and Conditions:

1. Orders in India will be shipped within 5-8 business days after order is placed. International orders will be shipped within 15-20 business days after order is placed.

2. Applicable Shipping will be charged, wherever required.

3. Coupon code valid only once per user.

4. No two promotions can be combined.

5. The Multiple product based coupons can be redeemed together.

6. Any third party coupons cannot be redeemed for the reduced price.

7. eShilp reserves the right to change or cancel the promotion at its discretion.

8. Any fraudulent activities, including creating duplicate accounts, aliasing, placing multiple orders or violating the terms and conditions will lead to order cancellation.
